Terms and Conditions

1) Guarantee of Quality:  Justimagi.net Ltd., trading as Midge Free Zone, guarantees that all manufacturer's/supplier's products meet the required standards for the purpose they were intended. The Mosquito Magnet® is also known as the Midge Magnet®.

2) Payment Options: Delivery of orders will be made within 30 days from receipt of cheque made out to "Justimagi.net  Ltd." Payment may also be made by Credit Card, Switch, Delta, Solo, BACS or bank transfer. State the payment method where requested however click on Pay by Credit Card, Cheque, Phone or Fax in all cases to complete the order process. The normal delivery time within the UK is seven days from receipt of order.

3) Returns Procedure: Midge Free Zone makes every effort to ensure orders arrive in perfect condition. However, in the unlikely event of a order not being delivered within 15 working days from the despatch date (Saturdays, Sundays & United Kingdom Public Holidays not included) customers should advise Midge Free Zone by e-mail - info@midge-free-zone.net. Midge Free Zone will make every effort to locate the order, and if necessary, send a replacement at our expense or provide a full refund, subject to the correct delivery address having been supplied to us with the order. If a order arrives damaged in any way, customers should contact Midge Free Zone by e-mail within 7 days of receipt. In this case Midge Free Zone will, depending upon our customers' preference, arrange for the damaged product to be picked up and returned to our warehouse. Midge Free Zone will either send a replacement product upon confirmation that the damaged product has been returned or make a refund. 

If you wish to cancel an order please cancel the order before the day of despatch. Under The Consumer Protection (Distance Selling) Regulations 2000, the consumer has a cooling-off period of 7 working days beginning on the day after the day on which the consumer receives the goods. A refund will be made within 30 days from the cancellation date, less the cost of the return if the goods are not returned by the consumer within this period.

4) Refunds: Refunds for valid claims will be made via the same method of payment as were used to place the order.

5) Delivery Methods & Times: Standard service deliveries within the United Kingdom are made with a delivery time of 3 working days. Please allow an extra working day for delivery to Scottish islands and remoter areas.

Please note that all orders MUST be signed for on delivery. If no-one is available on the first day to accept delivery, a card will normally be left through the consignee's letter box advising an attempt to deliver had been made. The carrier will normally telephone before making another delivery attempt. Deliveries are attempted twice (first delivery day & normally next working day), thereafter parcels may have to be collected from the local delivery depot. Midge Free Zone cannot be held responsible for delivery delays caused outwith of their control.

6) Retention of Title: This remains with Midge Free Zone until the goods are paid for in full.

7) Delivery Charges: These are automatically added to or included in the cost of the order as part of the process of submitting an order.

8) Application of Value Added Tax (VAT): VAT is included in the cost of each order, where applicable Justimagi.net  Ltd. VAT number GB 808 9067 05.

9) Stock Levels: Our shopping basket system is operated using an inventory with stock in hand. Confirmed orders indicate the item(s) ordered are in stock. If for any reason the stock levels show an item temporarily out of stock or insufficient quantity to meet the customers demands, please contact us by e-mail at info@midge-free-zone.net and we will advise the date that stock item will be available again.

10) Order Confirmations: Upon submitting an order using our automated shopping basket system, you will receive an 'Unconfirmed Order' e-mail from Midge Free Zone that shows the order has been received but payment still has to be made.  Once payment has been made or you have sent your cheque made out to "Justimagi.net  Ltd." and payment has been cleared, you will receive an 'Order Confirmation' e-mail, followed by a 'Confirmation of Despatch' e-mail, following despatch.

11) Confirmation of Despatch: Confirmation of despatch of orders will be sent by e-mail following despatch of all orders, showing consignment tracking number, if appriopriate, with date and time of despatch.

12) Invoices: Invoices are sent by post, with VAT details, to companies only within the UK. Others requiring a VAT receipt should request one by e-mail.

13) Order Inquiries: To follow up on the delivery of an order or for any inquiries e-mail info@midge-free-zone.net. Our office administration hours are 09.00 - 17.00 hrs, UK time, Monday to Friday, excluding Scottish Public Holidays.

14) Data Protection: Midge Free Zone does not sell to anyone its data base of customers and information contained on customers remains confidential to the distributors. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you (name, address, telephone numbers & e-mail address as submitted by you during the order process) for two reasons: firstly, to process your order and secondly, to provide you with the best possible service. 15) LIMITED WARRANTY: The Product manufacturer, American Biophysics Corp., having its principal place of business at 2240 South County Trail, East Greenwich, RI 02818 ("Manufacturer") warrants its Mosquito Magnet™ as follows:

a. Limited Warranty. Manufacturer warrants that the Products sold hereunder will be free from defects in material and workmanship for a period of one (1) year from the date of purchase with proof of purchase. If the Products do not conform to this Limited Warranty during the warranty period (as herein above specified), Buyer shall notify Manufacturer in writing of the claimed defects and demonstrate to Manufacturer satisfaction that said defects are covered by this Limited Warranty. If the defects are properly reported to Manufacturer within the warranty period, and the defects are of such type and nature as to be covered by this warranty, Manufacturer shall, at its own expense, furnish, replacement Products or, at Manufacturer's option, replacement parts for the defective Products. Shipping and installation of the replacement Products or replacement parts shall be at Buyer's expense.

b. Other Limits. THE FOREGOING IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Manufacturer does not warrant against damages or defects arising out of improper or abnormal use of handling of the Products; against defects or damages arising from improper installation (where installation is by persons other than Manufacturer), against defects in products or components not manufactured by Manufacturer, or against damages resulting from such non-Manufacturer made products or components. Manufacturer passes on to Buyer the warranty it received (if any) from the maker thereof of such non-Manufacturer made products or components. This warranty also does not apply to Products upon which repairs have been effected or attempted by persons other than pursuant to written authorization by Manufacturer.

c. Exclusive Obligation. THIS WARRANTY IS EXCLUSIVE. The sole and exclusive obligation of Manufacturer shall be to repair or replace the defective Products in the manner and for the period provided above. Manufacturer shall not have any other obligation with respect to the Products or any part thereof, whether based on contract, tort, strict liability or otherwise. Under no circumstances, whether based on this Limited Warranty or otherwise, shall Manufacturer be liable for incidental, special, or consequential damages. The manufacturer reserves the right to replace defective products with remanufactured components.

d. Entire Obligation. This Limited Warranty states the entire obligation of Manufacturer with respect to the Products. If any part of this Limited Warranty is determined to be void or illegal, the remainder shall remain in full force and effect.

16) Unforeseen Circumstances: While every effort will be made to meet shoppers demands, cancellations or variations may be necessary and delivery delays may occur as a result of Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or other causes beyond the control of Midge Free Zone. In such circumstances Midge Free Zone will not be liable to pay compensation.

17) If you have a complaint, please contact us immediately by e-mail to info@midge-free-zone.net. All complaints will be acknowledged normally within one working day. Any complaint will be dealt with fairly, effectively and confidentially. These complaints will normally be dealt within seven working days unless otherwise advised to the customer. These terms and conditions do not affect your consumer's statutory rights.

18) Law: These terms and conditions shall be governed by and construed in accordance with Scottish Law and you hereby agree to be subject to the jurisdiction of the Courts of Scotland.
